Second-degree Murder

Typically called “felony murder,” the statute defines second-degree criminal homicide as a crime that a person commits while perpetrating another felony as a principal or as an accomplice. This crime does not require any premeditation or deliberation, but the defendant does not have to be the person who carried out the homicide but only that he or she helped in the commission of a felony. A person convicted of felony-murder faces life incarceration without the possibility of parole.                                   

Third-degree Murder

Third-degree criminal homicide is the catch-all provision for all other kinds of homicide in Pennsylvania’s criminal statute. A third-degree criminal homicide occurs when one person kills another but without deliberation or premeditation and not during the commission of another felony. The crime of third-degree murder is punishable by up to forty years of jail time.

Voluntary and Involuntary Manslaughter

When a person kills another intentionally or knowingly, motivated by a sudden heat of passion caused by genuine provocation by the victim, and without legal justification, then that person may be charged with voluntary manslaughter. The crime is a first-degree felony that is punishable by ten to twenty years in prison. On the other hand, if an individual kills another unintentionally while performing a reckless or grossly negligent act, then that person has committed involuntary manslaughter. This offense is a first-degree misdemeanor that is punishable with two and a half to five years of jail time.
