Theft Charges and You
The FBI’s Uniform Crime Reporting (UCR) Program defines larceny-theft as “the unlawful taking, carrying, leading, or riding away of property from the possession or constructive possession of another. Examples are thefts of bicycles, thefts of motor vehicle parts and accessories, shoplifting, pocket-picking, or the stealing of any property or article that is not taken by force and violence or by fraud. Attempted larcenies are included. Embezzlement, confidence games, forgery, check fraud, etc., are excluded.”
The Bureau of Justice Statistics offers its own definition of larceny-theft: “Larceny-theft is defined as completed or attempted theft of property or cash without personal contact. Incidents involving theft of property from within the sample household would classify as theft if the offender has a legal right to be in the house (such as a maid, delivery person, or guest). If the offender has no legal right to be in the house, the incident would classify as a burglary.”
The Pennsylvania General Assembly declares that “a person is guilty of theft if he intentionally obtains or withholds property of another by deception.” They go on to clarify that “[deception] does not, however, include falsity as to matters having no pecuniary significance, or puffing by statements unlikely to deceive ordinary persons in the group addressed.”
